What the law protects when you work with an ordained minister.
In all 50 US states, conversations between an ordained minister acting in a professional spiritual capacity and a person seeking spiritual guidance are legally recognised as privileged communications — known as the clergy-penitent privilege. This offers you protections that standard coaching cannot.
In Canada, the Supreme Court established in R. v. Gruenke (1991) that confidential religious communications are protected on a case-by-case basis under the Wigmore Test — assessed individually by the court. Canada uses the broader term "religious communications" and takes a non-denominational approach under the Charter, meaning the protection applies regardless of faith tradition. For clients in other international jurisdictions, similar protections exist in many countries — and the ethical duty of confidentiality applies everywhere Andrea practices.

Privileged communications between you and an ordained minister cannot be subpoenaed or used as evidence in a court of law. Neither you nor your minister can be compelled to disclose what was shared in a confidential session.
Protected in Divorce Proceedings
What you share during sessions — including details about your marriage, your struggles or your intentions — is protected from disclosure in divorce and family court proceedings, provided the communication remains confidential.
Protected in Child Custody Cases
Sensitive disclosures made during counselling with an ordained minister are shielded from compelled testimony in custody disputes — giving you the freedom to speak openly without fear that your words will be used against you.
Protection Around Trauma & Violence
If you have experienced abuse, violence or deep trauma and choose to share this in a ministerial coaching context, that communication carries the weight of clergy privilege — protecting your story from unwanted legal exposure.
Stronger Than Standard Coaching
Privileged communications between you and an ordained minister cannot be subpoenaed or used as evidence in a court of law. Neither you nor your minister can be compelled to disclose what was shared in a confidential session.
Both Parties Are Protected
In most states, both you and the minister may assert the privilege. This means your minister cannot be forced to testify against you — and you have the right to prevent any disclosure of your confidential communications.
HOW THE PRIVILEDGE WORKS
What makes a communication privileged.
For the clergy-penitent privilege to apply, three conditions are generally required: the communication must be made in confidence, it must be made to an ordained minister acting in their professional spiritual capacity, and it must be of a spiritual, pastoral or counselling nature.
In the United States, this privilege is recognised across all 50 states and is comparable in strength to attorney-client privilege. In many states it cannot be waived by the minister — only by the person who shared the communication. It covers verbal conversations, written correspondence, phone calls, video sessions and other forms of communication made in confidence.
In Canada, the Supreme Court's landmark ruling in R. v. Gruenke (1991) established that religious communications are assessed on a case-by-case basis using the Wigmore Test — weighing the importance of confidentiality against the interests of justice. The Charter's multicultural framework means this protection applies non-denominationally, regardless of your faith background.
For clients outside North America, the ethical duty of ministerial confidentiality applies in all circumstances — regardless of the legal framework of your jurisdiction.
Note: The clergy-penitent privilege does not apply to disclosures of child abuse. In most jurisdictions ordained ministers are mandatory reporters of known or suspected abuse of a minor. Andrea is committed to the safety of children and will always comply with mandatory reporting requirements.

CHILD CUSTODY DISPUTES
